The pros and cons of ending a lease

It can make sense to get out early but the new lessee must watch out for some curves

Bert DeSouza enjoyed driving his 2006 Subaru Legacy GT wagon until a job change that allowed him to work at home meant his expensive Subie would languish in the garage.

It was time to part company — a formidable challenge when you’re leasing.

“I had 11 months left on the lease at $606 per month. Returning it early would have required paying a penalty in the thousands,” says DeSouza.

Like a growing number of Canadians, DeSouza advertised his car and his lease on a lease-takeover “remarketing” website and found a willing second lessee.

To help grease the transaction, he offered the new lessee $1,250 cash and paid the transfer fee (about $400); in return, DeSouza was released from his contractual obligations.

“For the original lessee, it represents an alternative to the tyranny involved with early lease termination where it sometimes feels like the dealer and automaker want a pound of flesh,” says George Iny, president of the Automobile Protection Association.

“Typical cost for an early lease return runs in the $2,500 to $5,000 range — with $10,000 not unheard of for a prestige vehicle or for someone ending a lease in the first year.”

At the same time, used-car shoppers are turning to lease-takeover services to find late-model used cars and trucks as an alternative to scanning the classifieds and looking online for used vehicles to buy.

“Savvy people are using the site,” says DeSouza. It’s especially useful if you’re looking for luxury vehicles or hard-to-find specialty models, he notes.

Mississauga-based Leasebusters.com pioneered the lease takeover concept in 1990 and dominates the market today.

Jacob W. is a ‘Car Guy’. He loves to get a new vehicle as often a feasibly possible. One day he decided that he was bored with his Audi S4 and it was time to get something new.

Jacob has a friend who drives a convertible and uses LeaseBusters.com every fall to find a winter ride. He suggested that Jacob start looking on the website for some of the amazing deals to be had.

After looking at the huge selection of sports cars available, Jacob decided to investigate what it would take to get out of his Audi lease. He filled out the online lease evaluation form and was contacted by Cheryl, one of the LeaseBusters evaluation team. Cheryl advised Jacob that his lease package was attractive, due to the low payment, short term remaining and ample kilometres left to drive. Jacob took the plunge and engaged LeaseBusters to help him move his Audi.

Within a few days, Jacob had several emails and a few phone calls from interested parties wanting to look at his car. He had made a down payment when he took the lease and had offered his security deposit as an incentive to make his lease package even more attractive. The first person who saw the car decided the deal was too good to pass up and a verbal agreement was reached.

Audi Downtown Toronto was quite familiar with the lease transfer process and looked after all of the credit checks and paperwork. Jacob was impressed with how seamless the whole process was.

Now it was time to find a replacement for the S4. Jacob was fortunate that he owned a motorcycle that he could use while he searched for his new ride and lucked out with incredibly warm weather. He always liked the BMW M3 and went to his local dealer for a test drive and quote. Although he was happy with the results, he found a better deal at LeaseBusters.com. Last weekend he made the trek to Kitchener and found that the owner had babied the car and had all of the service records available.

B.C. skier saved over $5,000 getting out of her Acura TL

Nicole N. from Maple Ridge, British Columbia enjoyed fast cars, alpine skiing and being one of the best food brokers in Western Canada. Two years ago Nicole’s employer stopped offering a company vehicle which compelled Nicole to acquire her own vehicle. As a result, she did some vehicle research and with the assistance of some trusted friends and her accountant; she decided to lease a brand new 2008 Acura TL.

The 2008 Acura TL was touted as one of the nicest looking and best performing Acura models in a long time, however this body-style was coming to an end at the end of the model year. Given the impending new style announcement, Acura was finding that the demand for the 2008 model was waning due to the anticipation of the “new” TL. Accordingly, Acura made an announcement to offer some very aggressive lease rates and cash incentives to stimulate more sales of the 2008 TL models. The “stimulus package” worked very well in Nicole’s eyes as well as many other customers the day Nicole went to visit a popular Acura store. Nicole ended up negotiating a great deal on a new TL and took delivery of the car four days later.

Nicole carried on with her fast paced life and enjoyed every minute of it. She developed new accounts, skied as much as she could and took several weekend road trips with her fabulous new car. What Nicole didn’t realize, at the time, was that she was racking up more kilometres than she should have been, based on the lease’s 24,000 annual kilometre allowance. In two years, Nicole’s TL had 72,000kms, yet she should have only had 48,000kms.

- Over mileage charge would have been over $7,000-

Nicole quickly discovered that if she kept going at her current rate she would have over 144,000kms on the TL at the end of the lease; this amount represented an overage of 48,000kms at $0.15 per kilometre or $7,200.00 in excess km charges. Although Nicole was earning good money, she certainly did not plan on allocating that kind of money at the end of her lease.

One of Nicole’s colleagues suggested that she call Leasebusters to get their opinion. Nicole called, spoke to a Lease-Take-Over Sales Analyst and received some excellent advice. It was determined that the monthly payment that Nicole was paying for her TL ($580.00 including taxes) was at least $120.00 per month better/cheaper than a new T. Remember the aggressive interest rates and cash incentives at the time? The $120.00 per month savings over the balance of the lease could be worth over $2,500.00 in monthly payment savings, to the right buyer.

Nicole was also educated about the Leasebusters cash incentive system that recommended lease-take-over Sellers, like Nicole, to offer up cash to make a lease even more attractive to a Buyer. The Leasebusters sales analyst also indicated that there are several customers in the lease-take-over market that drive less than 10,000kms per year that could find her deal quite attractive, providing there was a cash incentive to sweeten the deal. Nicole really liked what she was hearing and felt that it was time to do something now to save money in the long run.

-A $1,500 cash incentive got the phone ringing-

Nicole took a day or two to think about her options and to also decide what she is going to replace the TL with. The Leasebusters sales analyst suggested that she replace a vehicle with another lease-take-over vehicle. Doing so would possibly help her mitigate some of her own lease-take-over costs but she could also search and sort the Leasebusters lease-take-over inventory by “Free kms per year” which will help her find a vehicle that has at least 35,000kms per year allowance.

Nicole retained Leasebusters the next day after determining that there were at least 15 vehicles that she would consider that had kilometre allowances of over 30,000kms per year. Within the first week Nicole had received telephone calls and emails from customers that appeared to be very interested in her vehicle despite the excess kilometres. Nicole addressed and spoke with every customer and she was quite taken aback. Despite offering $1,500 as a cash incentive, there were a number of customers that we requesting twice the cash incentive amount she was offering. Nicole dismissed these requests and kept dealing with the other inquires.

-Nicole knew she had a good deal-

In the end, Nicole was becoming quite adept at dealing with her inquiries; she was able to immediately let customers know how good her lease deal was and how fair her $1,500.00 incentive was and that she would not entertain any reasonable offers unless the customer was approved by Acura Financial Services. This strategy immediately separated the truly interested parties from the “tire-kickers”. After about 2 weeks and 3 appointments, Nicole was negotiating in good faith with a couple from the interior of BC. The couple loved the car and Nicole knew it; it was all about the financials from this point onward.

After a series of emails and credit approval by the leasing company; Nicole and the couple agreed on a $1,900.00 cash incentive and splitting the $400.00 lease transfer fee. After it was all said and done, Nicole got out of her lease for under $2,500.00 and took over a lease on a Mini (fast and fun remember) that had 32,000kms per year available (with just under 3 years remaining on the lease) where the original lessee paid all of the transfer fee and the inspection fee.

Nicole figures that she saved well over $5,000.00 plus some serious maintenance charges that she would have been responsible for should she have kept the TL.

Nicole indicated that she would highly recommend Leasebusters to anyone who would like to change their vehicle for whatever the reason. She had no idea about all the pros and cons about her lease and one telephone call set her in the right direction.

Estate Finds Buyer for Leased Camry

Ajay from Scarborough, Ontario suffered a terrible loss with the passing of his sister in February of 2010. Fortunately, most of her personal and financial affairs were in order and were dealt with appropriately by Ajay. The only outstanding piece of business that Ajay, as executor, had to address was his sister’s leased Camry.

The Camry was the top of the line XLE V6 model that had all the available options including leather interior, power sunroof, electronic climate control, alloy wheels, power group and more. There were 12 months remaining in the lease which was held by Toyota Financial Services and the car had just over 70,000kms, which was well under the 96,000 km limit. Ajay felt that although the car was the top of the line model, the monthly lease payment was a little high at $568.00 per month including taxes.

One of Ajay’s colleagues who had just completed a lease-take-over transaction with Leasebusters, suggested he give Leasebusters a call to get their thoughts on the feasibility of someone taking over the lease on the Camry. Ajay called Leasebusters a couple of days later and after completing the short Leasebusters’ online pre-registration form he recieved a free assessement and evaluation by a Leasebusters sales analyst.

Within 24 hours a Leasebusters sales analyst provided Ajay with a thorough market position evaluation of the Camry and a strategy to enhance the position and desirability of the car lease. Essentially a cash incentive of $1,200.00 was recommended in order to lower the effective payment by $100.00 per month (since there were 12 months remaining in the lease, $1,200.00 became the “magic number” for the cash incentive). Other items that were mentioned as part of the strategy was posting a telephone number that could be answered by Ajay during regular business hours. Answering the telephone on all listings is vital since the majority of Buyers will not leave a message. They will simply move to the next vehicle on their shortlist.

Ajay decided to retain Leasebusters the next day as he felt quite confident that the Camry was a very desirable vehicle on a short term basis, despite the recent recalls and negative press bestowed upon the Toyota Corporation. The Leasebusters sales analyst also indicated the Camry is still amongst the most popular midsize sedans in terms of succesful lease-take-over transactions.

Ajay received five good leads over the first couple of weeks of the listing but none materialized into an appointment. He also received three electronic “offers” through the online offer system.

Most of the customers were looking for a Camry but Ajay’s Camry was competing against the base “LE” models (which were $150.00 to $175.00 per month less expensive); moreover the competitors were less expensive 4 cylinder models. Ajay quickly became very knowledgeable about Camrys and he was able to let customers know that his Camry was not in the same class as a base model.

By the 4^th week Ajay had arranged 2 appointments with properly qualified customers. He purposely made the appointments on the same day to be held at the original selling Toyota dealership. As suggested by the Leasebusters sales analyst, appointments are best to be held at the dealership in the event that one of the Buyers wants to finalize a deal.

The first customer liked the Camry but was waffling due to some stone chips on the hood of the car and some very minor door dings on the drivers and passenger front door. The second customer was an experienced leasing customer and knew that the minor parking lot dings and stone chips were considered normal and decided to make Ajay an offer to do a deal immediately.

After some back and forth banter and number crunching, Ajay agreed to give the Buyer a $1,500.00 cash incentive and the Buyer agreed to pay for the vehicle’s safety inspection. One of the last strategies that the Leasebusters sales analyst provided to Ajay was the waiver of transfer fees.

Since the Camry lease-take-over was an estate issue, most factory leasing companies will waive the transfer fee and Toyota Financial was no exception. The $400.00 transfer fee savings allowed Ajay to up the incentive by $300.00 and everyone was a winner. Ajay was very satisfied with the results and reported back to Leasebusters that he will consider taking over a lease for his next vehicle acquisition.

My wife and I had a 2008 Ford Escape, which is a great car, but now with two children in car seats and a double stroller in the back, we found that there was just not enough room in the car. If we needed to purchase items like new furniture for one of our kids, we would have to borrow my sister-in-laws mini-van and with two kids of her own, sometimes this was very hard to set up. If we went grocery shopping we would need to make sure that we had enough room to store everything, and sometimes I would have to make a second trip to go back and pick up larger items.

-Roomy Escape, just not roomy enough-

We knew by getting into a mini-van, days like these would be less stressful. As well, with our oldest child in school and the younger one getting ready for school, setting up a car-pool was going to be an issue as we were unable to drive more than two kids. Most families at our school need to be in a car-pool with other families that have the capability to drive three or four kids and this was just not possible in the Ford. So we started researching mini-vans and found that the Dodge Caravan had everything that we needed and what we were looking for. After talking with the sales representative we realized that the new mini-van was going to be less expensive per month, as long as we could get out of our current lease. We also have another super rare 2010 Challenger, equipped exactly the same as this car except it is all black. Its actually called Brilliant Black Crystal Pearl Coat. Even the stripes are black.
